Terms and Conditions

1. Finality of Owner’s Decision

The Renter expressly agrees that in any dispute regarding the vehicle's condition, interior cleanliness, fuel levels, or the assessment of damages, the decision of Om Car Rental (the "Owner") shall be final, conclusive, and binding. The Renter waives any right to contest the Owner's professional judgment or cost estimations.

2. Security Deposit

• Amount: A mandatory security deposit of ₹3,000 must be paid before the vehicle is handed over.
• Usage: The Owner reserves the right to deduct amounts from this deposit for late fees, traffic fines, fuel shortages, cleaning charges, or damages.
• Excess Liability: If the total cost of damages or penalties exceeds ₹3,000, the Renter is legally obligated to pay the balance amount immediately upon the Owner’s demand.

3. Fuel Policy

• Return Level: The vehicle must be returned with the same amount of fuel that was provided at the start of the rental period.
• Refuelling Charge: If the vehicle is returned with less fuel, the Renter will be charged for the cost of the missing fuel plus a ₹200 service fee for refuelling. No refunds or credits will be given if the vehicle is returned with more fuel than originally provided.

4. Late Return Policy & Penalties

• Late Fee: Any delay in returning the vehicle beyond the scheduled time will attract a penalty of ₹100 per hour.
• Partial Hours: Any fraction of an hour will be rounded up and charged as a full hour.
• Unauthorized Extension: If the vehicle is not returned within 6 hours of the scheduled time without prior written approval, it will be reported as stolen to the police.

5. Cleaning & Maintenance

• Cleanliness: The vehicle must be returned in the same state of cleanliness as it was received.
• Cleaning Fee:If the interior is found to be excessively dirty (e.g., mud, food spills, stains, or smoking odors), a professional cleaning fee of ₹500 to ₹1,500 will be deducted from the deposit at the Owner's discretion.

6. Absolute Liability for Damage & Accidents

• Total Indemnity: The Renter is 100% liable for any and all damage to the vehicle (including scratches, dents, glass breakage, or tire damage) and any accidents, regardless of fault.
• Zero Owner Liability: The Owner shall not be held liable for any personal injury, death, or loss of property occurring during the rental period.
• Loss of Use:If the vehicle is grounded for repairs, the Renter must pay a "Downtime Charge" (equivalent to the full daily rental rate) for every day the car is in the workshop.

7. Theft and Total Loss

In case of theft or total loss, the Renter is liable to pay the Full Market Value of the vehicle to the Owner.

The Renter must provide the original keys and a police FIR immediately. Failure to produce the keys will be treated as gross negligence.

8. Traffic Fines & Prohibited Use

• Fines: The Renter is solely responsible for all traffic/parking fines.
• Prohibited Use: The vehicle must not be used for racing, off-roading, or illegal activities. Any violation incurs a ₹5,000 breach of contract fee.
